These Terms of Service govern your use of Your Songs Forever and any orders placed through our website. By accessing our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our service.

1. About Your Songs Forever

Your Songs Forever is a personalized music creation service. We use advanced music generation technology, guided by human creative direction and curation, to craft one-of-a-kind songs based on the stories, memories, and details you share with us. Each song is created exclusively for the individual who orders it.

2. Eligibility

To use our service, you must be at least 18 years of age or the legal age of majority in your jurisdiction, have the legal capacity to enter into a binding agreement, and not be prohibited from using our service under any applicable law. You must also have the authority to share any personal information about third parties mentioned in your song request.

By placing an order, you confirm that you meet all of the above requirements.

3. Acceptable Use

You agree to use Your Songs Forever only for lawful purposes and in a manner consistent with these Terms. The following are strictly prohibited:

Submitting content that is defamatory, obscene, threatening, hateful, or that infringes on the rights of others. Providing false or misleading information about yourself or any person mentioned in your request. Attempting to interfere with, disrupt, or compromise the functioning of our service or underlying systems. Using automated tools, bots, or scripts to access or interact with our service. Attempting to reverse engineer, decompile, or extract any part of our proprietary technology, workflows, or processes. Reselling, redistributing, or commercially exploiting our service or its outputs without written authorization. Attempting to circumvent any security, access, or content controls.

We reserve the right to refuse, cancel, or suspend any order or account that we determine, at our sole discretion, violates these Terms or is otherwise inappropriate.

4. Your Song Request & Submitted Content

When you place an order, you submit personal details, memories, names, and other information ("Your Content") for the purpose of creating your song. You retain ownership of Your Content. By submitting it, you grant Your Songs Forever a limited, non-exclusive license to use, process, and transform Your Content solely to fulfill your order.

You represent and warrant that you have the right to share any information about individuals referenced in your request, and that Your Content does not violate any applicable law or the rights of any third party. You are solely responsible for the accuracy of what you provide. Errors in spelling, names, or details submitted at the time of order will be reflected in the final song.

Please note: Your Content is processed through third-party technology services as part of the song creation process. By placing an order, you acknowledge and consent to this processing.

5. How Songs Are Created — Important Disclosures

Every Your Songs Forever song is created using sophisticated music generation technology combined with human creative oversight. By placing an order, you acknowledge the following:

Nature of Generated Content

Lyrics are generated based on the information you provide. Music, melody, and vocals are produced based on those lyrics. The final output is a creative interpretation — not a verbatim translation — of your story. Generated content may contain unexpected creative choices, stylistic interpretations, or minor imperfections.

Limitations of the Creative Process

Technology cannot perfectly capture every emotional nuance or personal context. Musical style, vocal tone, tempo, and delivery may vary from your expectations. Names and specific words may occasionally be pronounced differently than intended. Creative decisions may differ from what a human songwriter would produce. Content safety systems may modify or restrict certain content during the generation process.

No Guarantee of Specific Output

We do not guarantee that the generated song will match your exact vision. Creative output is inherently subjective. While we are committed to quality and offer a complimentary remake for genuine issues (see Section 7), subjective dissatisfaction with creative interpretation is not grounds for a refund.

6. Pricing & Payment

All prices are displayed at checkout in US dollars and are subject to change without notice. Payment is required in full before song creation begins. You are responsible for any applicable taxes based on your location.

Payments are processed securely through a trusted third-party payment provider. Your Songs Forever does not store or have access to your payment card information.

7. Complimentary Remake Policy

We stand behind our work. Each order includes one (1) complimentary remake, subject to the following conditions:

Eligibility

Remake requests must be submitted within 24 hours of your song delivery email. You must provide clear, specific feedback identifying what needs to be corrected — such as incorrect details, style mismatch, tempo issues, or name pronunciation.

Scope

A remake addresses problems with the original song based on your submitted request. It is not an opportunity to create an entirely different song for a different recipient, occasion, or story. One remake per order. No additional remakes are available after the complimentary remake has been delivered.

Limitations

The complimentary remake is your sole remedy for dissatisfaction with the creative output of your order. It is not a refund and does not entitle you to a new order at no charge. After your remake is delivered, the order is considered complete and final.

8. Refund Policy

All sales are final once song production begins. Because every song is custom-created for you, we are unable to offer refunds based on subjective dissatisfaction with creative choices, style, or interpretation. The complimentary remake described in Section 7 is the designated remedy for creative concerns.

Limited Refund Exceptions

Refunds will be considered only in the following circumstances: a verified technical failure on our end that prevents delivery of your song, or a confirmed duplicate charge for the same order. To request a refund under these exceptions, contact us at support@yoursongsforever.com with your order details. All refund decisions outside of these exceptions are at our sole discretion.

Cancellations

If you wish to cancel an order before production begins, you must contact us within 12 hours of placing your order. We cannot guarantee cancellation once production is underway.

9. Ownership & Personal Use License

Your License

Upon full payment and delivery, Your Songs Forever grants you a personal, non-exclusive, non-transferable, perpetual license to use your custom song for personal, non-commercial purposes. This includes private listening and sharing with family and friends, playback at personal events such as weddings, birthdays, and anniversaries, and sharing on personal, non-monetized social media accounts.

What You May Not Do

You may not sell, sublicense, or transfer your song to any third party. You may not use your song in advertising, promotional materials, monetized content, or commercial distribution. You may not submit your song to music streaming platforms for commercial release. You may not claim authorship or copyright ownership of the generated content.

Our Retained Rights

Your Songs Forever retains full ownership of all generated content, including the composition, production, and all underlying elements. We will never publicly share your personal song or the details behind it without your consent. We reserve the right to create songs for other customers using similar styles, themes, or musical elements.

10. Intellectual Property

All content on the Your Songs Forever website — including text, graphics, logos, and site design — is the exclusive property of Your Songs Forever and is protected by applicable intellectual property laws. Unauthorized reproduction or use of our brand assets is strictly prohibited.

Songs generated through our service are created using proprietary workflows and technology. While we strive to produce original output, AI-assisted music generation may occasionally produce results that bear unintentional similarity to existing works. Your Songs Forever makes no warranty that generated content is free from resemblance to third-party material. You assume responsibility for evaluating your song before any use beyond the personal license granted herein.

11. Disclaimer of Warranties

The Your Songs Forever service is provided "as is" and "as available" without warranties of any kind, express or implied. We make no guarantee that the service will be error-free, uninterrupted, or that the output will meet your specific expectations. Generated content may contain imperfections, creative deviations, or technical variations. Nothing in this section limits any rights you may have under applicable consumer protection laws in your jurisdiction.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Your Songs Forever's total liability for any claim arising from your use of our service shall not exceed the amount you paid for the specific order giving rise to the claim. Under no circumstances shall Your Songs Forever be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the service or any generated content.

13. Indemnification

You agree to indemnify and hold harmless Your Songs Forever, its owners, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, your submission of inaccurate or unauthorized content, or your infringement of any third-party rights.

14. Service Availability

We make every effort to keep our service running smoothly, but we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. Your Songs Forever is not liable for any inconvenience or loss resulting from service downtime.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected by the updated effective date at the top of this page. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the United States. Any disputes not resolved informally shall be subject to the jurisdiction of the appropriate courts. We encourage you to contact us first at support@yoursongsforever.com — most issues can be resolved quickly and directly.
